When Mamdani started getting strong voter support we immediately questioned if Zorhan Mamdani would take the oath of office which requires him to swear that he will defend and protect the United States Constitution and if he would honor such oath.
Zorhan Mamdani has publicly proclaimed that he is a “Democratic Socialist.” However, the policies that he proclaims to support publicly are communist and Marxist to the core.
Additionally, Mamdani identifies as a Shia Muslim.
Most Muslims worship Islam. Islam is Sharia law and Sharia law is Islam. They are one in the same. The tenets of Sharia law are antithetical to the provisions and protections of the United States Constitution. Islamists and Islamic political groups like the Council on American Islamic Relations (CAIR) have long sought to replace the United States Constitution with Sharia law.
Zorhan Mamdani’s strong advocacy for Marxist doctrine, communist policies and Islamist doctrine may influence his willingness to take the official oath of office and/or honor such oath.
Mamdani cannot take any actions as mayor until he is officially sworn in.
The New York Times reported the following in part:
Mr. Mamdani’s term officially begins at 12:01 a.m. on January 1, 2026, as dictated by the City Charter. He must, however, take an oath of office before commencing his duties as mayor, according the State Constitution.
“Mr. Mamdani will promise to uphold the U.S. Constitution, the New York State Constitution, and the City Charter.” But will he?
“Mr. Mamdani has not publicly discussed plans for his swearing-in ceremony. A campaign spokeswoman declined on Thursday to comment on them.”
Article XIII, Section 1 of the New York State Constitution specifies the exact wording of the oath that members of the legislature, and all executive and judicial officers (except inferior officers exempted by law), must take before entering their duties:
"I do solemnly swear (or affirm) that I will support the constitution of the United States, and the constitution of the State of New York, and that I will faithfully discharge the duties of the office of ______, according to the best of my ability;".
The New York Constitution and Public Officers Law also require all public officers to take and file this oath.
Additionally, the New York State Constitution's Article XII, Section 1 states as a policy declaration that "the defense and protection of the state and the United States is an obligation of all persons within the state".
The U.S. Constitution's Fourteenth Amendment, Section 3 (the Disqualification Clause) bars any government officer who has taken an oath to support the Constitution and then "engaged in insurrection or rebellion" against the U.S. from holding future public office. This can result in both removal from their current office and a ban from holding future state and federal offices.
Mamadani may lie when taking the oath. While Sharia generally forbids lying but it allows it to mislead an enemy in battle. Taqiyya is a specific concept, often associated with Shi'a Islam, which allows for the dissimulation or concealment of one's faith when facing persecution or potential harm. While it was originally a survival tactic, its definition has been redefined in some anti-Muslim discourse to mean lying to non-Muslims as a general obligation. But even if Mamdani lies in taking the oath his actions of disobeying the oath should be evident.
The Governor of New York can remove certain public officials, like mayors, for cause, including violating their oath of office.
If Zorhan Mamdani violates his oath of office in a significant and public way New York Governor Kathy Hochul, who is running for re-election against a two strong Republican candidates, may want to publicly show that she opposes Mamdani's extreme policies by having him removed from office.
