Joe Biden nominated Magistrate Judge Sarah Netburn on April 30, 2024 to be a United States District Judge for the Southern District of New York to replace retiring Judge Lorna G. Schofield.

The US Senate Judiciary Committee held a confirmation hearing for several judges including Netburn on May 22, 2024.

Several US Senators criticized Judge Netburn as a far left political activist who twisted the Constitution to justify moving a male rapist into a female prison thereby putting vulnerable women in danger.

The Judiciary Committee did not vote on Netburn’s nomination on May 22, 2024.

Florida Family Association launched an email campaign that made it possible for people to send emails to urge 98 of the 100 US Senators to vote against Judge Sarah Netburn’s nomination.  Thousands of people sent emails.

On June 11, 2024, the Independent Women’s Forum (IWF), Independent Women’s Voice (IWV), and the Independent Women’s Law Center opposed Sarah Netburn’s nomination to the U.S. District Court for the Southern District of New York because she recommended that a biological male convicted of rape and child molestation be transferred to a federal women’s prison.

On June 13, 2024, Senate Minority Leader Mitch McConnell, R-Ky., torched President Biden's judicial nominee Sarah Netburn for engaging in "political activism from the bench" after transferring a transgender convicted rapist to a women's prison.  Senator McConnell said in this video that “the judiciary committee has received almost 100 letters from liberals opposing her nomination.”

Congress.gov reports that the last action for her confirmation was the May 22, 2024  Committee Hearing which did not take a vote on her confirmation.
